Developer: Uber Dad Jokes LLC (“we,” “our,” “us”)

These Terms & Conditions (“Terms”) govern your access to and use of the Trivia Battle mobile application and related services (“App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. ELIGIBILITY

To use the App, you must:

  • Be at least 13 years old to create an account

  • Be at least 18 years old to participate in any contest with cash or monetary prizes (future feature)

  • Use the App only in jurisdictions where participation is lawful

We reserve the right to refuse or revoke access for violations of these Terms.

2. ACCOUNT REGISTRATION

You may sign in via:

  • Apple Sign-In (email + Apple-issued user ID)

  • Other platform authentication methods if added in the future

You agree to:

  • Provide accurate information

  • Choose an appropriate username

  • Not impersonate others or misrepresent your identity

  • Keep your account secure

  • Be responsible for all activity under your account

We may require you to choose a new username if it violates our rules.

3. USER CONTENT

You may submit trivia questions, answers, feedback, host-created games, team names, support messages, and other content (“User Content”).

You agree that:

  • You own your submitted content or have the right to submit it

  • Your content does not infringe copyright, trademark, privacy, or publicity rights

  • You will not upload copyrighted trivia from protected sources (e.g., Jeopardy!, commercial trivia packs, textbooks, paid services)

By submitting content, you grant Uber Dad Jokes LLC a:

  • Worldwide, perpetual, irrevocable, royalty-free, transferable license

  • To use, modify, display, distribute, reproduce, and create derivative works

  • For any purpose related to the App, including training models, hosting games, and improving gameplay

User Content may be reviewed by admins before acceptance into the permanent trivia pool.

4. COMMUNITY RULES

You agree not to:

  • Cheat, manipulate, or exploit gameplay

  • Harass, threaten, or abuse other players

  • Use offensive, hateful, or inappropriate usernames

  • Submit harmful, malicious, or illegal content

  • Attempt to access the App’s backend, database, or systems

  • Interfere with the App’s functionality or servers

Violation may result in removal, suspension, or permanent ban.

5. GAMEPLAY MODES

The App provides:

  • Practice Mode: Unlimited self-paced trivia

  • Battle Mode (1v1 or group): Timed trivia battles

  • Question Submissions: Users can submit new questions

  • Flagging/Reporting: Users may flag incorrect or inappropriate questions

  • Trivia Host Mode (Future): Build your own trivia games and scoreboards

  • Weekly Skill-Based Contests (Future): Live scheduled tournaments

Game results, answer timing, correctness, and other metrics are recorded to ensure fairness and prevent cheating.

6. WEEKLY CONTESTS (FUTURE FEATURE)

The App may offer optional free-to-enter, skill-based trivia contests with prizes.

To participate, you must:

  • Reside in a jurisdiction where skill contests are legal

  • Be at least 18 years old

  • Not pay any entry fee or make a purchase to increase your odds

All contests:

  • Are based on skill

  • Do not use chance or randomness to determine winners

  • Do not require payment or donations

  • Have fixed prizes announced before the contest

  • Limit users to one account per person

We may request proof of age or eligibility before awarding prizes.
Prizes may be revoked in cases of cheating, duplicate accounts, or policy violations.

Complete contest rules will be published separately within the App and updated as contests launch.

7. DONATIONS / TIP JAR

The App may include optional in-app purchases classified as “tips” or “donations.”

You acknowledge that:

  • Donations are entirely voluntary

  • Donations do not unlock features or offer any gameplay advantage

  • Donations do not affect contest outcomes or odds

  • Donations are processed by Apple; Uber Dad Jokes LLC does not receive your card details

  • Donations are non-refundable except as required by Apple’s IAP refund policies

8. VIRTUAL ITEMS

Virtual items such as:

  • Avatars

  • Customizations

  • Non-currency unlocks

Have no cash value and are not redeemable for money or goods.
We may modify or discontinue virtual items at any time.

9. ADMIN & MODERATOR ACCESS

The App may appoint community admins to review:

  • Question submissions

  • Flagged questions

  • Usernames

  • Support tickets

Admins cannot view:

  • Email addresses

  • Payment information

  • Donation history

  • Authentication credentials

Admins can take moderation actions but cannot alter Supabase data unrelated to content moderation.

10. INTELLECTUAL PROPERTY

All rights in:

  • The App

  • Logos, graphics, branding

  • Game mechanics

  • Original trivia content

  • Custom artwork and avatars

Are owned by Uber Dad Jokes LLC or its licensors.

You may not:

  • Copy, modify, distribute, reverse-engineer, or reuse the App

  • Extract question databases for commercial use

  • Claim ownership of App content

11. PROHIBITED CONDUCT

You may not:

  • Attempt to hack, manipulate, or disrupt servers

  • Circumvent timers or gameplay mechanics

  • Use scripts, bots, or automation

  • Use VPNs or multiple accounts to manipulate contests

  • Create multiple accounts or identity-fraud accounts

  • Impersonate staff or admins

We reserve the right to terminate accounts for security, fairness, or legal reasons.

12. ACCOUNT TERMINATION

We may suspend or terminate your account if you:

  • Violate these Terms

  • Harm the community

  • Engage in fraud or cheating

  • Submit illegal or copyrighted content

  • Abuse support channels or moderators

You may terminate your account at any time via the App (Delete Account feature).
Account deletion is permanent and removes all stored personal data, subject to anonymized analytics retention.

13. DISCLAIMER OF WARRANTIES

The App is provided “AS IS” and “AS AVAILABLE.”

We do not guarantee that:

  • Questions are error-free

  • The App will always function without interruption

  • Servers will be free of bugs or downtime

  • All content is accurate or up to date

You use the App at your own risk.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Uber Dad Jokes LLC is not liable for:

  • Loss of winnings, earnings, or anticipated prizes

  • Data loss or account loss

  • Network issues

  • Gameplay inaccuracies

  • Damages arising from misuse or user actions

  • Third-party service interruptions (e.g., Apple, Supabase, network providers)

Total liability, if any, is limited to the amount you paid for the App (typically $0).

15. DISPUTE RESOLUTION

Before filing a claim, you agree to contact us for an attempt at informal resolution.

Disputes may be subject to:

  • Tennessee law (your LLC’s home jurisdiction)

  • Small claims or arbitration depending on local requirements

You agree not to pursue class-action lawsuits against us.

16. CHANGES TO TERMS

We may update these Terms from time to time.
When updated, the new date will appear at the top of this document.
Continued use of the App constitutes acceptance of updated Terms.
